Part 1: RCS Messaging Terms of Service

These terms apply to the Misfit Children Rich Communication Services (“RCS”) messaging program and supplement the website Terms of Service below.

1. About the Messaging Program

When you opt in, Misfit Children may send messages about product drops, restocks, promotions, and other brand updates. If you separately sign up for order notifications, we may also send order and shipping updates.

RCS messages may include images, videos, and interactive buttons. Available features depend on your device, messaging app, and carrier.

2. Consent to Receive Messages

By providing your mobile number and expressly opting in, you agree to receive the types of messages described at signup, which may be sent using automated technology.

Consent to marketing messages is not a condition of purchase. Visiting our website or placing an order does not, by itself, enroll you in marketing messages.

You confirm that you are the account holder or authorized user of the number provided. Please notify us if you change or give up that number.

3. Message Frequency & Charges

Message frequency varies based on product launches, promotions, and your interactions with the program.

Misfit Children does not charge a separate subscription fee for these messages. Message and data rates may apply, depending on your mobile plan. Contact your carrier for details.

4. How to Opt Out

You can opt out at any time by replying STOP to a Misfit Children message or using an unsubscribe option provided in the conversation. You may also request removal by emailing misfitchildrenn@gmail.com.

After opting out, you may receive one nonmarketing message confirming your request. No further messages will be sent through the program unless you opt in again.

Opting out does not cancel an order. Necessary order communications may still be sent by email.

6. Availability & Delivery

RCS messaging requires a compatible device, messaging app, and carrier. Delivery may be delayed or unavailable because of network conditions or technical issues.

If our program supports SMS or MMS fallback, messages may be delivered through those channels only where your consent covers them. Applicable message and data rates may apply.

Messaging notifications are provided for convenience. For questions about an order or its status, contact customer support.

7. Privacy

Our collection and use of your mobile number, messaging preferences, and interactions are described in our Privacy Policy, available on our website.

Our messaging providers and mobile carriers may process information needed to operate and deliver the service, as described in the applicable privacy notices.

8. Changes to the Program

We may modify, suspend, or discontinue the messaging program, subject to applicable law. Material changes will be communicated where required. If a change requires new consent, we will obtain it before sending messages under the changed terms.

9. Your Legal Rights

Nothing in these messaging terms limits consumer or privacy rights that cannot legally be waived.

Part 2: Website Terms of Service

These terms govern your use of the Misfit Children website and purchases from our store. By using our website or placing an order, you agree to these terms. If you do not agree, please do not use our services.

Agreement to these website terms does not, by itself, constitute consent to receive marketing messages.

1. Using Our Website

You must be legally able to enter into a binding agreement in your jurisdiction, or use our services with the involvement of a parent or legal guardian.

You agree not to use our website for unlawful purposes, interfere with its security or operation, or submit false or misleading information.

2. Products & Availability

We make reasonable efforts to display accurate product descriptions, images, colors, and sizing information. Colors may vary depending on your screen, and measurements may have reasonable manufacturing tolerances. This does not limit your rights if an item is defective or materially different from its description.

Products are subject to availability. We may change or discontinue products at any time, without affecting orders we have already accepted.

3. Prices & Payments

Prices are displayed in the currency shown at checkout. Applicable taxes and shipping charges will be shown before you submit your order.

Payment must be authorized before an order can be processed. Price changes do not apply to orders we have already accepted.

4. Orders

An order confirmation acknowledges receipt of your order; it does not guarantee acceptance. We may decline or cancel an order for reasons such as unavailable stock, suspected fraud, payment issues, or a material pricing or listing error.

If we cancel an order after payment has been collected, we will refund the amount paid for the canceled items, including applicable taxes and shipping charges attributable to those items.

Please check your shipping address and order details before submitting your purchase. We cannot guarantee changes or cancellations after an order is placed, except where required by law.

5. Shipping & Delivery

Shipping timelines begin after the website closes for the drop, not on the date you place your order. The closing date will be listed on our website for each drop.

• Premade items: Expected to ship within 5–8 days after the website closes.
• Preorder items: Expected to ship within 4–8 weeks after the website closes.
• Delayed preorders: Please allow up to 4 additional weeks, meaning some preorders may take up to 12 weeks after the website closes to ship.

These timelines refer to shipment, not arrival. Delivery time after shipment depends on the carrier and destination.

If we expect a delay beyond the stated shipping window, we will notify affected customers with an updated estimate and any cancellation or refund options required by applicable law. We will obtain your consent to a delay where legally required; these terms do not constitute advance consent to every delay.

If your order contains both premade and preorder items, they may ship together once the preorder items are ready, unless otherwise stated at checkout.

Once your order ships, you will receive a shipping confirmation email with tracking information. Tracking may take time to update after the carrier receives your package.

For international orders, any applicable duties or import charges not collected at checkout may be your responsibility. Relevant information will be provided in our Shipping Policy or at checkout.

If your package is lost, damaged, or incorrectly delivered, contact misfitchildrenn@gmail.com so we can investigate and assist. Nothing in these terms removes any delivery obligations or remedies required by applicable law.

6. Returns, Exchanges & Refunds

All sales are final, except as required by applicable law or provided in our Return & Refund Policy.

We do not accept returns or exchanges for change of mind, sizing, or color preference. Please review the product description and size guide before purchasing.

If you receive a damaged, defective, or incorrect item, contact misfitchildrenn@gmail.com within 7 days of delivery, with your order number, a description of the issue, and clear photos.

We will review the claim and arrange an appropriate resolution, which may include a replacement or refund. If a return is necessary due to our error or a confirmed defect, we will cover the return shipping costs. Please do not send anything back without contacting us first.

The 7-day reporting window and our all-sales-final policy do not limit consumer rights that cannot legally be waived, including any legally required remedies for shipping delays or failure to deliver.

7. Intellectual Property

Unless otherwise identified, the Misfit Children name, logos, original designs, photographs, text, and other website content are owned by Misfit Children or used with permission.

You may use our website for personal, noncommercial purposes. You may not reproduce, sell, distribute, or otherwise commercially exploit our protected content without written permission, except as permitted by law.

8. Reviews & Submitted Content

You are responsible for any reviews, photos, or other content you submit to our website. Your submissions must not violate another person’s rights or contain unlawful, abusive, or misleading material.

You retain ownership of your content. By submitting it, you grant us a nonexclusive, royalty-free license to display it and make formatting changes reasonably necessary to operate the review or submission feature. We will seek separate permission before using your content in advertising outside that feature.

9. Privacy

Our Privacy Policy explains how we collect, use, and share personal information. Please review it before using our website or placing an order.

10. Third-Party Services

Our website may link to third-party websites or use external payment and delivery services. Those providers may have their own terms and privacy policies.

We are not responsible for the content of independent third-party websites. This does not remove our responsibility for fulfilling your order or meeting our legal obligations.

11. Disclaimers & Limitation of Liability

We make reasonable efforts to keep our website accurate and available, but we cannot guarantee uninterrupted or error-free access.

To the extent permitted by law, Misfit Children is not liable for indirect or consequential losses arising from use of our website or products.

Nothing in these terms excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence, or any other liability or consumer protection that cannot legally be excluded or limited.

12. Governing Law & Disputes

These terms are governed by the laws of the State of North Carolina, United States, without overriding any mandatory consumer protections that apply where you live.

13. Changes to These Terms
